Terms and Conditions
§ 1 Scope and Provider Identity
1.1. These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop www.miracles.my concluded between us and you as consumer.

1.3. Consumer within the meaning of these Terms and Conditions is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (§ 1 KSchG).
1.4. The version of these Terms and Conditions valid at the time of contract conclusion is authoritative.
1.5. Deviating conditions of customers are not recognized unless we expressly agree to their validity in writing.
§ 2 Conclusion of Contract
2.1. The presentation of our products in the online shop does not constitute a legally binding offer but an invitation to you to order products (invitatio ad offerendum).
2.2. By clicking the button "Order with obligation to pay", you place a binding order for the products contained in the shopping cart. Confirmation of receipt of the order is sent immediately after submission by an automated email (order receipt confirmation). This does not yet constitute acceptance of the contract.
2.3. The purchase contract is only concluded when we accept your order by a separate order confirmation via email or ship the goods.
2.4. The contract language is German.
2.5. The contract text is not stored by us and is no longer retrievable after the contract is concluded. However, you can print or save the contract text before submitting the order.
§ 3 Our Products – Personalized Children's Books
3.1. We sell personalized children's books in which children become the heroes of their own story.
3.2. To personalize, upload a photo of the child and select hair and eye color. Our system creates a character-accurate image in the illustration style of the chosen book.
3.3. In addition, we offer the following optional additional services:
- Premium Paper
- Hardcover
- Personalized Posters
- Personal Dedication
3.4. We strive to represent our products as accurately as possible. Minor color or display deviations may occur due to technical reasons (e.g., different screen settings) and do not constitute a defect as long as they do not significantly impair usability.
3.5. We reserve the right to update product descriptions, remove products from the range, or limit order quantities per household.
§ 4 Prices and Payment
4.1. All prices stated are final prices in Euro and include the statutory Austrian VAT (currently 10% for books according to § 10 para. 2 no. 1 lit. a UStG).
4.2. Shipping costs are not included in the product prices and will be shown to you separately and transparently during the ordering process before completing the order.
4.3. The price stated at the time of order applies.
4.4. You have the option to choose from the payment methods specified during the ordering process. Payment is made depending on the chosen payment method:
- Credit card: Debit upon shipping
- PayPal: Debit at order completion
- Other payment methods: as indicated at checkout
4.5. You undertake to provide complete and correct payment data.
§ 5 Delivery and shipping
5.1. Delivery is made to the delivery address you provided.
5.2. The expected delivery time will be communicated to you during the ordering process and in the order confirmation. Unless otherwise stated, delivery takes place within 10–14 working days after conclusion of the contract (for personalized products after completion).
5.3. Transfer of risk: The risk of accidental loss and accidental deterioration of the goods only passes to consumers upon delivery of the goods to you, even if the goods have been handed over to a transport company (§ 7b KSchG).
5.4. We reserve the right to withdraw from the contract if the goods are not available. In this case, we will inform you immediately and refund any payments already made.
5.5. Our books are illustrated in Austria and printed in Germany.
§ 6 Right of withdrawal and exclusion for personalized goods
6.1. General right of withdrawal
As a consumer, you generally have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day you or a third party named by you took possession of the goods.
6.2. Exclusion of the right of withdrawal for personalized products
IMPORTANT NOTICE: According to § 18 para. 1 no. 3 FAGG (Distance and Off-Premises Contracts Act), there is no right of withdrawal for contracts for the delivery of goods that are made to customer specifications or clearly tailored to personal needs.
Since our children's books are individually personalized with your child's photo and name, they are goods made to customer specifications. The right of withdrawal is therefore excluded.
You will be explicitly informed of this exclusion before placing the order and must confirm it.
6.3. Right of withdrawal for non-personalized additional products
For non-personalized additional products (if available separately), the statutory right of withdrawal according to § 11 FAGG applies. To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., email to support@miracles.my) inform us of your decision.
§ 7 Warranty
7.1. The statutory warranty rights according to §§ 922 ff ABGB as well as the Consumer Warranty Act (VGG) apply.
7.2. The warranty period for consumers is two years from delivery of the goods.
7.3. For defects occurring within 12 months after delivery, it is presumed that the defect already existed at the time of delivery (reversal of the burden of proof according to § 924 ABGB).
7.4. If a defect is present, you initially have the right to improvement (repair) or replacement. If both are impossible or involve disproportionately high effort for us, you have the right to price reduction or rescission (contract termination).

§ 8 Liability
8.1. We are fully liable for damages resulting from injury to life, body, and health as well as for intent and gross negligence.
8.2. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations) and limited in amount to the typically foreseeable damage under the contract.
8.3. The liability limitations do not apply to claims under the Product Liability Act (PHG).
8.4. Liability for slight negligence cannot be excluded towards consumers (§ 6 para. 1 no. 9 KSchG).
§ 9 Retention of Title
The delivered goods remain our property until full payment of the purchase price.
§ 10 Copyright and Intellectual Property
10.1. All content of the online shop (texts, images, graphics, illustrations, designs, logos) is protected by copyright and is the property of Miracles.my or Pushed FlexCo or the respective licensors.
10.2. Use beyond personal, non-commercial purposes requires our express written consent.
10.3. By placing your order, you grant us the right to use the photo you uploaded exclusively for the creation of your personalized product.
10.4. You assure that you have the necessary rights to the uploaded photos and do not infringe on third-party rights.
§ 11 Data Protection
11.1. Information on the processing of your personal data can be found in our Privacy Policy: https://miracles.my/policies/privacy-policy
11.2. Data processing is carried out in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).
11.3. Uploaded photos are used exclusively for product creation and deleted after production is completed, unless you explicitly agree to longer storage.
§ 12 Technical Platform
12.1. The online shop is operated via the e-commerce platform Shopify.
12.2. Contractual partner and seller is exclusively Pushed FlexCo. Shopify is merely a technical service provider and is not liable for transactions, products, or damages related to your use of our shop.
§ 13 Prohibited Uses
13.1. The use of our services is permitted exclusively for lawful purposes.
13.2. The following are especially prohibited:
- Illegal use or use for illegal purposes
- Violations of copyright or other protective rights
- Uploading content for which you do not have rights
- Uploading offensive, illegal, or youth-endangering content
- Transmission of false information
- Attempt to circumvent security mechanisms
- Automated scraping of our content
13.3. In case of violations, we reserve the right to block access and initiate legal action.
§ 14 Online Dispute Resolution
14.1. The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr
14.2. Our e-mail address can be found above in § 1.
14.3. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 15 Applicable Law and Jurisdiction
15.1. Exclusively Austrian law applies, excluding the UN Sales Convention (CISG).
15.2. For consumers residing in the EU, the mandatory consumer protection provisions of the state of residence also apply, provided they are more favorable.
15.3. For consumers residing in Austria: For lawsuits against the consumer, the court is responsible in whose district the residence, habitual abode, or place of employment is located (§ 14 KSchG).
15.4. The place of jurisdiction for all disputes with entrepreneurs is Vienna.
§ 16 Severability Clause
16.1. Should any provision of these Terms and Conditions be invalid or unenforceable, the remaining provisions shall remain unaffected.
16.2. The invalid provision is deemed replaced by a valid one that comes closest to the economic purpose of the invalid provision.
§ 17 Changes to the Terms and Conditions
17.1. The current version of these Terms and Conditions can be viewed at any time on our website.
17.2. For existing contracts, the version valid at the time the contract was concluded applies.
